Release and Hold Harmless Agreement

This Release and Hold Harmless Agreement (“Agreement”) is made between [Volunteer’s Name Agreeing via web] (“Volunteer”) and [We The People Mission], a nonprofit(In-process) organization located at [Avery County Airport, 400 Brushy Creek Road, Spruce Pine NC] (“Organization”).

1. Voluntary Participation

By participating in the activities organized by the Organization, the Volunteer understands and agrees that their involvement is voluntary and that they may choose to discontinue their participation at any time.

2. Assumption of Risk

The Volunteer acknowledges that certain risks are inherent in volunteer activities and understands that these activities may involve risks including, but not limited to, physical activity, interaction with others, travel, and exposure to potential hazards. The Volunteer assumes all risks and responsibility for any and all injuries, damages, or losses that they may sustain as a result of participating in these activities.

The Avery County Airfield is located near an active Quartz mine – Sibelco. If you have any respiratory and or pulmonary issues, please do not volunteer at this location. The Avery County Airfield and W34P Foundation Incorporated – We The People Mission are not liable for health issues.

3. Release of Liability

The Volunteer, on behalf of themselves, their heirs, representatives, executors, and assigns, hereby releases and forever discharges the Organization, its officers, directors, employees, agents, and assigns from any and all liability, claims, demands, or causes of action that may arise from the Volunteer’s participation in the Organization’s activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

4. Hold Harmless

The Volunteer agrees to hold harmless and indemnify the Organization from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of their involvement in the Organization’s activities, and to reimburse the Organization for any such expenses incurred.

5. Medical Treatment

The Volunteer consents to receive medical treatment deemed necessary if injured or ill during the course of volunteering, with the understanding that the Organization will not be responsible for any associated costs. The Volunteer is encouraged to carry personal health insurance.

6. Confidentiality

The Volunteer agrees to keep confidential any and all information they may have access to as part of their volunteer work with the Organization. This includes, but is not limited to, information about clients, donors, and the Organization’s proprietary practices.

7. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles.

8. Acknowledgment of Understanding

The Volunteer affirms that they have read and fully understand this Agreement, and that they voluntarily agree to its terms as a condition of their involvement in the Organization’s activities.

Electronic Signature Agreement

By checking the I agree box and signing up to volunteer, the Volunteer affirms that they have read and agree to the terms of this Release and Hold Harmless Agreement.No Volunteer may participate without agreeing to these terms.
